1. Introduction and acceptance of these Terms

Welcome to PullSubtitle. PullSubtitle is operated by [LEGAL NAME], an individual / sole trader operating under the laws of [COUNTRY / REGION] ("PullSubtitle", "we", "us" or "our"). These Terms of Service ("Terms") govern your access to and use of the PullSubtitle website at https://www.pullsubtitle.com and the transcript extraction service offered there (together, the "Service").

By creating an account, subscribing to a plan, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood and agree to be bound by these Terms; (c) agree to our Privacy Policy, Cookie Policy, Refund & Cancellation Policy and Acceptable Use Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

Important: if you do not agree to these Terms, you may not use the Service. Continued use after an update to these Terms means you accept the revised Terms.

2. Service description

2.1 What we provide

PullSubtitle is a web-based software-as-a-service (SaaS) tool. You paste a link to a publicly available video on a supported platform (currently YouTube, TikTok, Instagram, Facebook, X (Twitter), LinkedIn, Reddit, Rumble, Twitch clips, Kick clips and the Meta Ad Library) and the Service returns a text transcript of the video, the video's publicly visible details (such as title, creator, publish date, duration and engagement counts), and export files in formats such as TXT, SRT, VTT, CSV, JSON and Markdown. Depending on your plan, the Service can also transcribe a video's audio using automatic speech recognition when no captions exist, process several links in one batch, and export publicly visible comments.

2.2 Nature of the Service

The Service is a digital, intangible product delivered over the internet. Paid features and plan credits are made available to your account immediately after payment is confirmed. Because of this immediate digital delivery, the specific refund rules in Section 7 apply.

2.3 Third-party data and AI providers

To retrieve captions and public video information, the Service relies on third-party data providers, and automatic speech recognition is performed by third-party AI models. Results depend on what the source platform makes publicly available and on these providers' availability. We are not affiliated with, endorsed by or sponsored by YouTube, TikTok, Meta, X, LinkedIn, Reddit, Rumble, Twitch or Kick; their names are used only to describe compatibility, and all trademarks belong to their owners.

3. Accounts and eligibility

3.1 Account creation

You must sign in with a Google or GitHub account to use the Service. You must provide accurate information and you are responsible for all activity that happens under your account. Accounts that use the same verified email address with both sign-in providers are treated as one account.

3.2 Account security

• Notify us immediately of any unauthorized use of your account at contact@pullsubtitle.com.
• Do not share your account or let others use your sign-in.
• Keep the email address on your account up to date, because billing and security notices are sent there.

3.3 One free account per person

Free credits are intended for individual evaluation. Creating multiple accounts to collect additional free credits is not allowed and may result in suspension of all related accounts.

3.4 Business accounts

If you register on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Plans and credits

4.1 Plans

We offer a Free plan and two paid subscription plans, Starter and Pro, each available with monthly or annual billing. Current plan names, prices, billing cycles and included features are always shown on our pricing page. At the effective date of these Terms they are:

4.2 How credits work

Usage of the Service is measured in credits. A transcript costs 1 credit; long-video AI transcription (videos over two minutes) costs 3 credits per started minute; exporting a video's comments costs 2 credits. Extractions that return no transcript, and re-opening or re-downloading a transcript already in your history, do not use credits. The current price list is shown on the pricing page and on your balance page.

4.3 Plan credits do not roll over

Credits included in a subscription are granted at the start of each 30-day credit cycle, including on annual plans, and expire at the end of that cycle. They do not carry over to the next cycle. Free daily credits expire at the end of the UTC day and do not accumulate.

4.4 Credits have no cash value

Credits are a usage allowance, not currency or stored value. They cannot be sold, transferred, exchanged for cash or refunded on their own, and they are forfeited when a plan ends or an account is terminated, except where a refund is given under Section 7.

4.5 Changes to plans

We may change plan features or introduce new plans. Price changes to an existing subscription take effect only from your next renewal after we have notified you, and you may cancel before then.

5. Billing and payment

5.1 Recurring billing authorization

By subscribing to a paid plan, you expressly authorize us, through our reseller described in Section 5.2, to charge your payment method on a recurring basis for the subscription fee shown at checkout: every month for monthly plans and every year for annual plans. Your subscription renews automatically at the end of each billing period until you cancel in accordance with Section 6. We send advance notice before an annual subscription renews.

5.2 Merchant of Record

Orders are processed by our online reseller & Merchant of Record, Waffo Pancake, who also handles order-related inquiries and returns. Payment card data is processed exclusively by Waffo Pancake, a PCI-DSS compliant payment platform, and is never stored on our servers. Your card statement and receipts may show Waffo Pancake as the seller.

5.3 Taxes

Prices shown on the pricing page exclude applicable taxes (such as VAT, GST or sales tax) unless stated otherwise. Where required by law, taxes are calculated and collected at checkout by our Merchant of Record.

5.4 Plan changes

You can switch between Starter and Pro from the pricing page. When you upgrade, the difference in monthly credits is added to your balance immediately and any price difference is handled by checkout. When you downgrade, the change applies according to the option shown at checkout.

5.5 Failed payments

If a renewal payment fails, your subscription may be marked past due. If payment is not recovered, your paid plan ends at the close of the paid period and your account returns to the Free plan.

6. Cancellation

6.1 How to cancel

You can cancel at any time, without contacting us: - Online (recommended): Dashboard → Current plan → Cancel subscription. - Email: send a cancellation request from your account email to contact@pullsubtitle.com. We process email requests within 2 business days.

6.2 Effect of cancellation

• Your subscription stays active, with its remaining credits, until the end of the current billing period.
• You will not be charged for later billing periods.
• When the paid period ends, your account returns to the Free plan, remaining plan credits expire, and transcripts are kept according to the Free plan's history period.

7. Refunds

Our full Refund & Cancellation Policy forms part of these Terms. In summary:

7.1 General policy

Because the Service is delivered digitally and immediately, subscription fees are generally non-refundable except as set out below.

7.2 Eligible refunds

• 7-day guarantee for new subscribers: a full refund of your first subscription payment if you ask within 7 days of that charge and have used no more than 20% of the plan's credits for that cycle.
• Annual plans: a full refund within 7 days of an annual charge under the same usage condition; a pro-rated refund of the unused months may be offered within 30 days at our discretion.
• Duplicate charges or billing errors: always refunded in full.
• Service failure: if the Service is unavailable for 72 consecutive hours or more for reasons within our control, we offer a pro-rated refund or credit.
• Statutory rights: any mandatory consumer right to withdraw or obtain a refund under the law of your country (for example, in the EU or UK) is preserved.

7.3 Non-refundable items

• Billing periods already used, except as stated in Section 7.2.
• Annual fees requested more than 30 days after purchase.
• Accounts terminated for breaching these Terms or the Acceptable Use Policy.

7.4 How refunds are paid

Approved refunds are issued to the original payment method by our Merchant of Record, Waffo Pancake, and usually appear within 5–10 business days. When a subscription payment is refunded, the related plan and its credits end.

8. Billing disputes

If you believe a charge is wrong, please contact us at contact@pullsubtitle.com before disputing it with your bank. We respond within 2 business days and resolve confirmed billing errors within 5 business days.

9. Content, transcripts and intellectual property

9.1 Third-party content

Videos, captions, comments and other material retrieved through the Service ("Third-Party Content") belong to their creators and rights holders. PullSubtitle does not claim ownership of Third-Party Content and does not grant you any rights in it. The Service only provides access to material that the source platform already makes publicly available, for your personal or internal use.

9.2 Your responsibilities

You are responsible for how you use transcripts and other outputs. You must ensure your use complies with copyright law (including any fair use or fair dealing exceptions that apply where you live), the source platform's terms, and the rights of the people who appear in the content. Republishing large portions of someone else's content generally requires the rights holder's permission.

9.3 Inputs

By submitting a video link ("Input"), you grant us a limited, non-exclusive license to process it solely to deliver the Service to you. We do not use your Inputs or transcripts to train AI models.

9.4 Our intellectual property

The Service itself, including its software, design, text and the PullSubtitle name and logo, belongs to us or our licensors. You may not copy, modify, reverse engineer or create derivative works of the Service except as permitted by law.

9.5 Accuracy of AI transcription

Transcripts produced by automatic speech recognition are labelled "AI transcription" and may contain errors, especially with names, technical terms, accents, music or overlapping speech. Captions retrieved from platforms are provided as published by the platform. You are responsible for reviewing outputs before relying on or publishing them.

9.6 Copyright complaints

If you believe content accessible through the Service infringes your rights, follow the procedure in our Acceptable Use Policy. We remove or disable access to material where appropriate and suspend repeat infringers.

10. Acceptable use

10.1 Permitted uses

You may use the Service only for lawful purposes and in accordance with these Terms, for example for research, study, accessibility, journalism, commentary, and repurposing content you own or are licensed to use.

10.2 Prohibited uses

You agree NOT to: - use the Service to access private, restricted, paywalled or login-only content, or content you are not entitled to view; - republish, sell or distribute Third-Party Content in a way that infringes intellectual property, privacy or publicity rights; - use transcripts to harass, defame, dox, stalk or impersonate anyone, or to create deepfakes or other deceptive content about real people; - use the Service for spam, fraud, phishing, malware or any illegal activity; - automate access to the Service (bots, scripts, scrapers) beyond the features we provide, or try to circumvent credit limits, rate limits or security measures; - create multiple accounts to obtain extra free credits, or share, resell or sub-license access to your account without our written approval; - use outputs of the Service to train, fine-tune or benchmark a machine-learning model that competes with the Service; - violate any applicable law, regulation, platform terms or card-network rule.

11. Data, privacy and security

Your use of the Service is governed by our Privacy Policy and Cookie Policy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on our servers. Account data is retained for 90 days after account deletion or termination and then deleted, except where we must keep records longer by law.

12. Disclaimers and limitation of liability

12.1 Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THE ACCURACY OR COMPLETENESS OF TRANSCRIPTS. WE DO NOT GUARANTEE THAT ANY PARTICULAR VIDEO WILL HAVE A TRANSCRIPT, OR THAT THIRD-PARTY PLATFORMS WILL CONTINUE TO MAKE CONTENT AVAILABLE.

12.2 AI-generated content disclaimer

AI transcription can be inaccurate or incomplete. Do not rely on transcripts for legal, medical, financial or other professional decisions without checking the original video.

12.3 Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULLSUBTITLE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing in these Terms limits liability that cannot be limited by law.

12.4 Indemnity

You agree to indemnify us against claims arising from your misuse of the Service or your breach of these Terms, including claims by rights holders about how you used Third-Party Content.

13. Suspension and termination

These Terms apply for as long as you use the Service. We may suspend or terminate your account, with or without notice, if you materially breach these Terms or the Acceptable Use Policy, if we reasonably suspect fraud or abuse (including free-credit abuse or chargeback abuse), or if required by law. Where reasonable, we will tell you why and give you a chance to respond. If we terminate your account for reasons other than your breach, we will refund the unused portion of any prepaid period. You may close your account at any time by contacting contact@pullsubtitle.com.

14. Governing law and disputes

These Terms are governed by the laws of [COUNTRY / REGION], without regard to conflict-of-law rules. Before starting any formal proceedings, please contact us at contact@pullsubtitle.com so we can try to resolve the issue informally. Mandatory consumer-protection rights in your country of residence are not affected.

15. Changes and general provisions

We may update these Terms from time to time. We will give at least 14 days' notice of material changes by email or an in-product notice, and update the date at the top of this page. Continued use after the effective date means you accept the changes. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
